These Terms of Service (“Terms”) govern your access to and use of the PehriJo website, mobile applications, and related services (collectively, the “Services”) operated by Valkya Creations Private Limited (“PehriJo”, “Company”, “we”, “our”, or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

PehriJo provides an artificial intelligence-powered virtual clothing try-on platform that allows users to:

Upload photographs and clothing images;

Generate AI-powered virtual try-on images;

Store and manage generated images;

Access additional features that may be introduced from time to time.

The Services are available through our website, mobile applications, APIs, and other platforms that we may provide.

You may use the Services only if:

You are at least sixteen (16) years of age; and

You have the legal capacity to enter into a binding agreement.

If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.

4.1 Account Creation

To use certain features of the Services, you must create an account using a valid mobile number and complete OTP verification.

You agree to:

Provide accurate information;

Keep your account information current;

Maintain the security of your account.

4.2 One Account Per User

You may not:

Create multiple accounts;

Circumvent account restrictions;

Create new accounts to avoid suspension or termination.

4.3 Account Security

You are responsible for:

Maintaining the confidentiality of your account;

Restricting access to your device;

All activities that occur under your account.

You must immediately notify us of any unauthorized use of your account.

Businesses, brands, retailers, and other organizations may use the Services subject to these Terms.

Business users represent and warrant that they:

Have all necessary rights and permissions to upload content;

Have obtained all required consents from individuals whose photographs are uploaded;

Comply with applicable privacy and data protection laws.

Business users are solely responsible for their relationships with their customers and end users.

6.1 Ownership

You retain ownership of:

Photographs you upload;

Clothing and fabric images you upload;

AI-generated images created from your content.

6.2 License Granted to PehriJo

By uploading content to the Services, you grant PehriJo a limited, non-exclusive, worldwide, royalty-free license to:

Host;

Store;

Reproduce;

Process;

Modify;

Display;

Create temporary copies;

Generate outputs;

solely for the purpose of operating, maintaining, securing, improving, and providing the Services.

This license terminates when your content is deleted, except to the extent that:

Backup copies exist;

Retention is required by law;

Retention is necessary for fraud prevention, dispute resolution, or security purposes.

You represent and warrant that:

You own the content you upload or have the necessary permissions to use it;

You have obtained consent from individuals appearing in uploaded photographs;

Your use of the Services does not violate any law or third-party rights;

You will not upload copyrighted material without authorization.

PehriJo uses artificial intelligence technologies to generate virtual try-on images.

You acknowledge and agree that:

AI-generated outputs are computer-generated simulations;

Results may not be accurate;

Generated images may differ from real-world appearance;

Color, texture, size, fit, and proportions may not be accurately represented;

The Services do not provide professional fashion, tailoring, sizing, or styling advice.

The Services are provided for informational, visualization, and creative purposes only.

You agree not to:

Upload illegal content;

Upload content that infringes intellectual property rights;

Upload sexually explicit or pornographic material;

Upload child sexual abuse material or exploitative content;

Upload hateful, abusive, defamatory, or discriminatory content;

Create deceptive deepfakes or impersonations;

Harass or threaten other persons;

Violate privacy rights;

Upload malware or harmful code;

Use automated scripts, bots, or scraping tools;

Reverse engineer or attempt to extract source code;

Share accounts with other users;

Circumvent usage limitations;

Create multiple accounts to bypass restrictions;

Use the Services for unlawful activities;

Interfere with the operation or security of the Services.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

Your use of the Services is also governed by our Privacy Policy.

By using the Services, you consent to the collection and processing of information as described in our Privacy Policy.

Certain features of the Services may require:

Payment of subscription fees;

Purchase of credits;

Paid plans or premium services.

Pricing, billing terms, and available plans will be displayed on the Services and may be modified from time to time.

Continued use of paid services after pricing changes constitutes acceptance of the revised pricing.

Payments may be processed through third-party payment providers.

You agree to provide accurate billing information.

You authorize us and our payment providers to charge all applicable fees associated with your use of the Services.

Unless otherwise required by applicable law:

Payments are generally non-refundable;

Subscription fees are non-refundable;

Consumed credits are non-refundable;

Completed generations are non-refundable.

Refunds may be issued at our sole discretion in cases involving:

Duplicate payments;

Technical failures;

Payment processing errors.

Separate refund policies may apply to specific products or services.

Users may delete their accounts through the Services.

Upon account deletion:

Your profile information may be deleted or anonymized;

Uploaded and generated images may be deleted;

Certain information may be retained where required by law or necessary for legitimate business purposes.

Except for User Content, all rights, title, and interest in and to the Services, including:

Software;

Source code;

Website content;

Mobile applications;

Logos;

Branding;

Trademarks;

Graphics;

Designs;

Documentation;

are owned by PehriJo and its licensors.

No rights are granted except as expressly provided in these Terms.

You may not:

Copy or reproduce the Services;

Reverse engineer the Services;

Create derivative works;

Resell or sublicense the Services;

Build competing products using the Services;

Use the Services to develop competing AI systems.

If you believe content on the Services infringes your intellectual property rights, please contact:

We may remove allegedly infringing content and suspend repeat infringers.

The Services may depend on third-party providers, including:

Cloud infrastructure providers;

Payment processors;

Artificial intelligence service providers;

Analytics providers.

We do not control and are not responsible for third-party services.

Interruptions or changes to third-party services may affect the availability of our Services.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that:

The Services will be uninterrupted;

The Services will be error-free;

The Services will always be available;

Any defects will be corrected.

We may:

Modify features;

Add or remove functionality;

Suspend services;

Discontinue services;

Perform maintenance at any time.

To the maximum extent permitted by law, PehriJo disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:

Merchantability;

Fitness for a particular purpose;

Non-infringement;

Availability;

Accuracy.

To the maximum extent permitted by law, PehriJo and its directors, officers, employees, affiliates, and licensors shall not be liable for:

Indirect damages;

Incidental damages;

Consequential damages;

Loss of profits;

Loss of business opportunities;

Loss of goodwill;

Loss of data.

Our total aggregate liability arising from or relating to the Services shall not exceed the total amount paid by you to PehriJo during the twelve (12) months immediately preceding the event giving rise to the claim.

You agree to indemnify and hold harmless PehriJo, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of:

Your use of the Services;

Your uploaded content;

Violation of these Terms;

Violation of any law;

Violation of third-party rights.

Business users additionally agree to indemnify PehriJo against claims arising from customer photographs or data uploaded without proper consent.

We may suspend or terminate your account immediately if:

You violate these Terms;

You engage in fraud;

You abuse the Services;

You engage in unlawful activity;

You fail to comply with payment obligations.

Termination may include deletion of your access to the Services.

We shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including:

Natural disasters;

Government actions;

Internet failures;

Cyberattacks;

Power outages;

Cloud service failures;

Telecommunications failures;

Labor disputes.

You agree not to use the Services in violation of any applicable export control laws, sanctions laws, or trade restrictions.

By using the Services, you consent to receive communications electronically, including:

Emails;

In-app notifications;

Website notices;

Legal communications.

Electronic communications satisfy any legal requirement that such communications be in writing.

Before initiating legal proceedings, you agree to contact PehriJo and attempt to resolve the dispute informally.

The parties agree to make good-faith efforts to resolve disputes within forty-five (45) days from the date written notice of the dispute is provided.

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Gandhinagar, Gujarat, India.

We may update these Terms from time to time.

Updated Terms become effective when posted on the Services.

Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and PehriJo regarding the Services.
